Kentucky deferred-deposit rules

Key limits that affect the cost and structure.

These points summarize current Kentucky law effective July 15, 2026. The statute and DFI control if a summary differs.

Service fee: max $15 / $100

KRS 286.9-100 caps the service fee at $15 per $100 of the deferred-deposit check's face amount and requires written disclosure before the transaction.

At least 14 days

The statutory service fee covers a period of at least 14 days. A licensee may not agree to hold a transaction longer than 60 days.

Up to two open transactions

A customer may not have more than two open deferred-deposit transactions. The total-proceeds limit is $600, subject to annual CPI-based adjustment and an $850 statutory ceiling.

No fee-based rollovers

A licensee or affiliate may not charge a fee to renew, roll over or otherwise consolidate a deferred-deposit transaction.

$3 statewide database fee

2026 legislation fixed the deferred-deposit database fee at $3 per transaction and permits that fee to be charged to the customer.

Database eligibility check

Licensees must use the Kentucky deferred-deposit database to verify eligibility and outstanding transactions as required by law.
